Distance Sales Agreement

1. Parties

The buyer is the natural or legal person who creates a membership, purchases a digital service, or places an order for a physical product through the Arenmex platform.

2. Subject

This agreement governs the sales, payment, delivery, withdrawal, and refund terms for digital subscriptions, engineering calculation services, stocked products, or custom-manufactured products prepared according to the technical dimensions, material, quantity, or drawing requested by the buyer and purchased electronically.

3. Nature of Product and Service

• Digital memberships are information, calculation, report, and output services provided electronically.
• Stocked products are offered for sale according to the specifications stated on the product page or quote/approval screen.
• Custom-manufactured products are prepared according to the buyer’s technical requests and needs.

4. Pricing and Payment

The buyer agrees to pay the product, service, subscription, tax, shipping, and any additional costs shown during purchase. The payment method is specified on the payment screen or during the quote/approval process.

5. Production, Shipping, and Delivery

• Physical product shipments are made from Turkey.
• For stocked products, preparation and handover-to-cargo time may be specified separately on the product page, quote/approval screen, or order email. The cargo company’s delivery time may vary depending on the delivery address and carrier operation.
• For custom-manufactured products, production time starts after approval of technical dimensions, material, quantity, quote, and payment. The parties may agree on a longer delivery period for the specific order.
• The cargo company, delivery fee, return carrier, and any additional costs are notified before payment or during order approval. Tracking information for shipped orders may be shared through the order screen, email, or tracking link provided on the website.

6. Right of Withdrawal and Exceptions

For digital memberships, if access to the service is provided or digital content is delivered with the buyer’s explicit approval, the right of withdrawal cannot be used within the exceptions under applicable legislation. For custom-manufactured products prepared according to the buyer’s requests or personal/technical needs, the right of withdrawal cannot be used as long as the product is not defective and is manufactured in accordance with the order; refund requests based on a change of preference are not accepted. For stocked physical products within the scope of withdrawal rights, the buyer may submit a withdrawal notice within 14 days from delivery. If the Company accepts a refund request based on the buyer’s change of preference even though the product is not defective and was delivered in accordance with the order, the return shipping/cargo cost belongs to the buyer to the extent permitted by legislation.

7. Resolution of Disputes

This agreement is governed by the laws of the Republic of Turkey. In consumer transactions, application rights to legally authorized Consumer Arbitration Committees and Consumer Courts are reserved. Istanbul Courts and Enforcement Offices are authorized for disputes that may arise with merchants or buyers who do not qualify as consumers.
